Two months after a Brazos County district court jury convicts a Bryan man of continuous sexual abuse of a girl under the age of 14, this week he learns his punishment.
34 year old Obispo Garcia was sentenced Tuesday (July 22) by the trial judge to 50 years in prison for the abuse that began in 2019.
Garcia is not eligible for parole due to the crime he was convicted of.
A news release from the district attorney’s office said in 2021, the then 11 year old victim recanted her original report under pressure from her mother.
A year later, following more abuse, the victim told her teacher, who in turn contacted Bryan police.
The victim was the oldest of three sisters. The D-A’s office says the sisters have been adopted.
BPD arrest reports say the victim’s two younger sisters were also sexually abused.
In September 2024, the mother of the three sisters pleaded guilty to child endangerment by allowing Garcia to have access to her daughters. Jail records show the mother, 37 year old Tomasa Batz-Ajche of Bryan, has served her state jail sentence.

Obispo Jose Tzoc Garcia has been sentenced to 50 years in prison for Continuous Sexual Abuse of a Child Younger than 14. There is no parole for this offense so the defendant will serve the entirety of his sentence.
A Brazos County Jury rendered their verdict convicting the defendant of the offense on May 21, 2025. The 50 year sentence was handed down by 361st District Court Judge David Hilburn after a punishment hearing concluded on July 22, 2025.
The jury heard testimony from the victim that the defendant repeatedly sexually abused her over a period of years. A second child also testified that the defendant sexually abused her as well. Both children lived in the same household as the defendant during the time the sexual abuse was ongoing.
The victim had previously reported the defendant’s sexual abuse in 2021, but then recanted under pressure to do so from her mother and al-so in the belief that the defendant would stop. The victim was 11 years old at that time.
The abuse did not stop, and nearly a year later the victim reported the defendant’s continued conduct to her teacher who then called the po-lice. Officers of the Bryan Police Department responded immediately and rescued all the children from the defendant’s residence. The defendant was found hiding under a bed while the victim’s mother lied to police by falsely reporting the defendant was at work. The victim’s mother had also taken the victim’s phone in an effort to prevent the victim from contacting police.
A sexual assault nurse examiner treated the victim later that same day. Evidence collected during the nurse’s examination revealed the defendant’s DNA on the victim’s breast as a result of the most recent act of sexual abuse committed by the defendant.
The child victims have since been adopted, and the victim’s mother was prosecuted for endangering her children in a separate proceeding where she was sentenced to serve time in a State Jail.
