Recap Of Two Jury Trials Scheduled This Week In Brazos County District Court

Two jury trials on criminal charges were scheduled this week in Brazos County district court. Two juries were picked, but only one was sworn in and heard testimony.

A College Station man was found guilty of failing to register as a sex offender. After the jury verdict, the judge sentenced 43 year old Orlando Santana to 15 years. According to the district attorney’s office, Santana was required to register after he was convicted 25 years ago for the sexual assault of a 72 year old woman. In January of last year, he was arrested for stealing a purse out of a car parked at the College Station city cemetery. During the booking process at the city jail it was determined he moved to town four months earlier, but did not register his new address.

A second jury that was selected this week was sent home before being sworn in. The last minute request by the DA’s office being granted by the judge allows prosecutors to bring back to trial a man charged with the continuous sexual assault of a child under the age of 14. According to the DA’s motion to delay the trial, prosecutors learned on December 28th the results of a second analysis of DNA evidence identified three people instead of two as originally thought. Another DNA profile is being done, but those results won’t be known until mid-March. WTAW News asked the DA’s office why they didn’t ask for a delay in the trial of 51 year old Rayford Smith of Calvert before bringing in potential jurors. Prosecutors said they could not comment because of three pending trials against Smith. He has been in jail since his arrest in May of 2013 on two counts of aggravated sexual assault of the same victim that’s the subject of the trial that was delayed this week.
