Motions Heard in Upcoming Brazos County Capital Murder Trial

A day and a half was taken in Brazos County District Court this week to consider pre-trial motions in an upcoming capital murder trial.

46 year old Stanley Griffin is accused of strangling Jennifer Hailey in her College Station apartment in September 2010.

A defense request to delay the start of the trial was granted. Jury selection was originally set to start April 5th. The new date has not been set.

District Judge Steve Smith denied a defense motion to have a second jury determine if Griffin is mentally retarded. That would not come into play unless the trial jury convicts Griffin of capital murder. If that happens and the jury decides Griffin is mentally retarded, Griffin could not be executed.

The judge has also taken under advisement, defense motions to suppress evidence.
