Mediation Underway Involving Proposed Private Landfill

Opposing parties to a proposed private landfill west of Easterwood Airport are meeting behind closed doors.

Closed door mediation began Wednesday and continued Thursday.

The mediation follows a public hearing Wednesday morning, which lasted less than 20 minutes because there was no public testimony.

All those in attendance who were against the landfill and eligible to speak were represented by a lawyer involved in the mediation process.

Comments from attorney Brent Ryan, representing the landfill applicant, and Administrative Judge Anne Perez.

When Administrative Judge Anne Perez of Austin received no response after asking if there were any other opponents who wanted speak, she proceeded to discuss procedural matters with lawyers for the applicant, the citizens group against the landfill, and the Texas Commission on Environmental Quality.

Mediation, which involved the lawyers and not the judge, is the latest step in a process that began in February and is expected to last until January. Another public hearing before the judge will take place as early as the second half of August.

Opponents had asked the City of College Station, whose extra-territorial jurisdiction includes the proposed landfill, to become an interested party. That was not done, according to Mayor Nancy Berry, appearing on WTAW’s The Infomaniacs, after consulting with their lawyers.

Nancy Berry responds to question from WTAW’s Scott DeLucia.
