A College Station man convicted of killing his girlfriend and her brother more than five years ago has returned to a Brazos County courtroom.

Lawyers for 30 year old John Thuesen are scheduled to spend all week arguing he did not receive adequate representation during his jury trial in May 2010 and after that before the Texas Court of Criminal Appeals.

Thuesen was given the death penalty for killing his girlfriend, Rachel Joiner, and her brother Travis.

Thuesen’s lawyers raised 22 issues. Among them, there were more people that could have testified that Thuesen suffered from post-traumatic stress disorder as the result of military service in Iraq…which could have led the trial jury not to give Thuesen the death penalty.

According to court records, Thuesen’s lawyers plan to present more than 30 witnesses…either in person or through affidavits.

This week’s hearings follows a ruling by the Texas Court of Criminal Appeals in late February upholding the jury conviction and sentence, rejecting 45 claims of trial error from Thuesen’s appelate lawyers.
