Innocent Man Leaves Prison

HOUSTON (AP) _ A Houston man who authorities say spent 19 years in prison for a rape he didn’t commit has been released.

The attorney for 39-year-old Allen Wayne Porter tells The Associated Press that Porter was released Friday afternoon. A judge had recommended his release Thursday after hearing testimony in the case.

Porter was released on a recognizance bond while awaiting a final decision by the Texas Court of Criminal Appeals.

If the appeals court accepts the judge’s recommendation, it will order a new trial. But Bob Loper, the special prosecutor, told the Houston Chronicle on Friday that he will move to dismiss the case, so Porter will not be retried.
