Closing Arguments in Capital Murder Trial on Hold

BRYAN, Texas (AP) _ Closing arguments in the capital murder case of a Texas prisoner charged with the 2007 death of a corrections officer during an escape attempt have been delayed.

Prosecutors are contesting the charge to be read to the jury in the case of John Falk Jr. and asked an appeals court Tuesday for a ruling. The trial began last week in Bryan on a venue change from Huntsville.

The 45-year-old Falk could face the death penalty if convicted of the death of Susan Canfield. She was fatally injured when inmate Jerry Martin rammed a stolen truck into her outside the Wynne Unit prison in Huntsville. Martin and Falk had staged the break, then sped away.

Prosecutors contend the jury charge is too limiting. Martin’s already on death row for Canfield’s death.
