Tuesday’s Bryan city council meeting includes the first discussion behind closed doors since the city responded to a lawsuit filed by a business fighting to keep a sign in its front yard.
Six weeks ago, the Austin corporation that owns Planet K adult novelty stores sued the city and Bryan’s zoning board of adjustments over its denial of a sign permit.
Planet K accuses the city of having a sign code that violates free speech rights under the first amendment. And Planet K says not having a sign permit has kept them from getting a permit to do business inside its building on South Texas.
The city’s response was filed Monday in Brazos County district court by a San Antonio law firm hired by the city.
The city’s lawyers claims the sign permit was denied because the sign has not been inspected for safety or hazards…and the sign issue is not the only reason Planet K has been denied a permit to occupy the building.
The Thursday before Christmas, a Brazos County judge will consider Planet K’s request for a temporary restraining order allowing the sign to stay pending a final outcome of the lawsuit.
