A Brazos County district court jury that didn’t have to determine the guilt or innocence in an armed robbery trial did decide on punishment.
While 45 year old Marcus Gutierrez asked for 25 to 30 years, Assistant District Attorney Jessica Escue says the jury decided on 60 years.
Gutierrez pleaded guilty to the October 2010 holdup of the College Station Holiday Inn Express, where he threatened to kill the 19 year old desk clerk with a knife then left with $191 dollars.
Escue says the jury also heard about pending charges accusing Gutierrez, while out on bond, of kicking an A&M police officer in the face and threatening retaliation as part of a drunk driving arrest with his children in his vehicle.
