Brazos County District Court Jury Trial Is Cancelled Following A Plea Agreement In A Case Involving Gunfire And Drunk Driving

A Brazos County district court jury trial scheduled to start Monday (June 3rd) was cancelled, involving charges of gunfire and drunk driving that took place in September of 2019.

Court records show a plea agreement between the district attorney’s office and 49 year old Marcus Hammock of College Station included five years probation from a suspended ten year prison sentence for his third DWI conviction.

A spokeswoman in the DA’s office said Hammock’s blood alcohol level was .082 with a confidence interval of +/- .004. Hammock’s blood also tested positive for cannabis.

Court documents show Hammock was not required to perform community service due to a disability.

The punishment also took into account, Hammock pleading guilty but not being prosecuted for aggravated assault with a deadly weapon. The DA’s spokeswoman told WTAW News that Hammock was not prosecuted for firing a shotgun into the floor of a home at the request of the victim.

Court documents also show Hammock gave up his right to appeal the DWI conviction and punishment.
