Brazos County Attorney Decision On Prosecuting Bryan Councilman Rafael Pena

Bryan city councilman Rafael Pena will not be charged with a class “A” or “B” misdemeanor assault by the Brazos County Attorney.

Thursday’s decision by Rod Anderson came after he listened to the 9-1-1 call, watched police video, and speaking with detectives involved in the April 20th incident.

Anderson says he has not been asked by the Bryan municipal court prosecutor to consider a class “C” charge.

City prosecutor Josh Galicia said he had “no comment” when asked by WTAW News about the incident at the home of Pena’s mother, where the councilman and his wife have been staying.
