Bilingual Education Overhaul Delayed

McALLEN, Texas (AP) _ An appeals court has delayed an overhaul of bilingual and English-as-a-second-language programs in Texas schools.

U.S. District Judge William Wayne Justice in 2008 ruled Texas schools had failed middle and high school students with limited English.

Justice ordered Texas to submit proposals for a new way of tracking and educating those students by Jan. 31.

But the 5th U.S. Circuit Court of Appeals last week responded to a requested delay from the state. The court says “a wide variety of concerns including funding, personnel changes and legislative authority” must be addressed first.

A Texas Education Agency spokeswoman says the delay gives legislators a chance to consider potential laws that could address the issue.

The McAllen Monitor reports the delay disappointed attorney David Hinojosa, whose lawsuit spurred the original court order.
