Appeals Court Hears Gay Divorce Case

DALLAS (AP) _ A lawyer for a Dallas man trying to divorce the man he married in Massachusetts told a Texas appeals court that his client is entitled to a divorce because he had a valid marriage.

Jody Scheske represents a man listed in court records only as “J.B.” He told a three-judge 5th Texas Court of Appeals panel in Dallas that the Dalls judge who granted the divorce “has the right to hear divorces from people who have valid marriages.”

But Jimmy Blacklock, an assistant Texas solicitor general, argues the men’s marriage isn’t recognized by Texas and can only be declared as having never happened.

The state is also appealing after an Austin judge this spring granted a divorce to two women.
