Texas AG Wants New Judge in School Finance Case

AUSTIN, Texas (AP) _ Attorney General Greg Abbott has asked the judge overseeing Texas’ sweeping school finance trial to recuse himself because of perceived bias.

In a District Court motion Monday, Abbott’s office said recent e-mails between Dietz and attorneys for the 600-plus school districts suing the state show the judge lacks impartiality.

Abbott, a Republican, is running for governor and not arguing the case. Still, his office’s motion asks Dietz to recuse himself or to refer the matter to a “regional presiding judge.”

The school districts sued in 2011, after the Legislature cut $5.4 billion in classroom funding.

Dietz ruled in 2013 that school funding was inadequate. But he reopened testimony this year, after lawmakers restored about $3.4 billion.

Dietz had been expected to issue a final, written ruling in the case soon.
