Former Brazos Valley Arts Council Director David Romei scored a partial win in his appeal of two jury convictions from a November, 2008 jury trial in Brazos County District Court.

The 10th Court of Appeals in Waco upheld a conviction of theft by deception. Romei was placed on community supervision for 5 years and was ordered to pay $268,000 in restitution.

Justices reversed a conviction for misapplication of fiduciary property and sent that back for a new trial. The jury found Romei guilty of making four illegal political contributions. The appeals court sided with Romei that three of the $250 donations were made outside the statute of limitations. The trial judge denied Romei’s motion to include the statute of limitations in jury instructions or dismiss that charge.
