Two Houston men admit to engaging in organized criminal activity that is associated with a convenience store burglary in Bryan two years ago.
Plea agreements with the Brazos County district attorney’s office sentenced 23 year old Brytavion Rogers to 30 years in prison and 21 year old Darius Davonn Wright to seven years. The prosecutor told WTAW News that the punishment was based on the criminal history of the two men.
Prosecutor Kevin Capps also says Rogers and Wright are also responsible for $6,000 dollars in restitution for damaging the store on March 5, 2024. The amount is based on damage to the store that was not compensated by insurance. An undisclosed amount of money taken from an ATM was recovered at the time they and three other men were arrested.
The plea agreement with Rogers also includes a guilty plea to a convenience store burglary and theft from an ATM that happened in Bryan on February 25, 2024. Capps said Wright was not charged in that burglary based on the evidence at hand.
A third Houston man who was arrested, 19 year old Torry Rector, pleaded guilty to a misdemeanor charge of failing to identify himself. Rector has completed a 180 day sentence in the Brazos County jail.
Two other Houston men who were arrested are awaiting trials on multiple felony charges. 30 year old Tristin Smith is jailed as of February 16th in lieu of bonds totaling $558,000 dollars. 21 year old Kenneth Gaston is out of jail after posting bonds totaling $150,000 dollars.

News release from the Brazos County district attorney’s office about charges against Brytavion Rogers:
361st District Court Judge David Hilburn sentenced Brytavion Rogers to 30 years in prison for coordinated burglaries conducted with other perpetrators.
On February 25, 2024, Rogers and other perpetrators burglarized a convenience store in Bryan by using tools to cut into the wall of the building to gain access to the interior. Once inside, the perpetrators cut into an ATM machine stealing cash.
On March 5, 2024, Rogers again used tools to cut into the wall of another convenience store in Bryan to reach the ATM machine inside. This time Rogers and the other perpetrators were observed by an individual who called police. Officers of the Bryan Police Department promptly responded to the area and stopped the perpetrators’ vehicle. A search of the vehicle revealed the tools used commit to the offense as well as cash and property stolen from the store.
In the course of further investigation, police obtained search warrants for the perpetrators’ phones. On Rogers’s phone, police found videos of Rogers committing both crimes.
Rogers was charged with two counts of Engaging in Organized Criminal Activity for his role in the burglaries along with burglary of a building and criminal mischief charges.
The offense of Theft from an ATM Machine in an amount of less than $300k is a 2nd degree felony which was upgraded to a 1st degree felony through the Engaging in Organized Criminal Activity statute.
Rogers pled guilty to all charges and during his punishment hearing it was shown that Rogers had previously been to prison for Robbery, Theft, and Evading with a Vehicle all out of Houston.
