The College Station city council avoids doing business with a contractor who conspired with a former city employee to steal hundreds of thousands of dollars by overcharging the city 15 years ago.
On a 6-1 vote, the council approved spending an additional 126 thousand dollars by going with the second lowest bidder on two contracts.
Rob Neal, the lawyer representing Carey Smith of Texcon General Contractors, says his client paid $150,000 dollars in restitution and served six months in jail as part of a deferred adjudication agreement that was successfully completed in July 2014.
Councilwoman Blanche Brick made the motion to support staff recommendations.
Mayor Karl Mooney seconded Brick’s motions.
Councilwoman Julie Schultz was the lone vote against the staff’s recommendation.
According to online court records, Smith entered the deferred adjudication agreement in 2009. The criminal complaint was filed in 2005 involving actions that occurred in 2002.
