Bryan Man Sentenced To Prison More Than Ten Months After Pleading Guilty To Possessing Child Pornography

A Bryan man is sentenced to prison more than ten months after pleading guilty to possessing child pornography.

A spokeswoman in the Brazos County district attorney’s office says the delay in sentencing 30 year old Kyle Joseph Simmons was because he had to get a new lawyer following the death of his former attorney.

Simmons was out of jail on bond from the day after he was arrested in September 2020 until his sentencing on February 12th.

The contested punishment hearing followed Simmons guilty plea in March of 2025. Simmons sought probation while prosecutors asked for at least seven years in prison. The judge decided on a four year prison sentence that covers five counts.

A tip to the National Center for Missing and Exploited Children led to Simmons arrest by the Texas attorney general’s child exploitation unit.

A search warrant executed at Simmons home led to the discovery of two videos and three images showing female victims between the ages of two and 11.

On February 12, 2026 Judge John Brick sentenced Kyle Simmons to four years in prison for Possession of Child Pornography following a punishment hearing. Simmons previously pled guilty to the offenses on March 3, 2025.

In April of 2020, Sergeant Adam Madore with the Office of Attorney General’s Child Exploitation Unit received a Cyber Tipline Report from the National Center for Missing and Exploited Children (NCMEC), reporting that the defendant had uploaded several files of child pornography onto his Google drive. After getting a search warrant, Sgt. Madore and several members of the OAG’s Child Exploitation Unit raided Simmons’s house and seized all of his electronic devices. A forensic search of the defendant’s devices revealed a large quantity of child pornography.

The defendant admitted to Sgt. Madore that he possessed a large quantity of child pornography, and said he specifically sought out photos of girls ages 11 to 13 years old. The search of Simmons’ electronic devices also revealed over 100 videos of the defendant masturbating at his place of employment.

Simmons had never been arrested before, and was a former firefighter for East Montgomery County Fire Department before being terminated as a result of this offense.

Statement from Brazos County assistant district attorney Jordan Jordan and first assistant district attorney Brian Baker: “Child Pornography is a business that abuses the most vulnerable people in our society for profit. The defendant, who was in a position of public trust, helped to exploit these children by his actions. Prison is the only punishment for his actions.”
