News release from the Brazos County District Attorney’s Office:

On June 17, 2025, Andrew Gutierrez was sentenced to 25 years in prison for the offense of Aggravated Assault with a Deadly Weapon. Judge David Hilburn also made affirmative findings of family violence and the use of a deadly weapon. As a result of the deadly weapon finding, the defendant will have to serve half his sentence before becoming eligible for parole. Then defendant has been previously convicted of Assault Family Violence Continuous where he served 5 years in prison back in 2016.

On January 13, 2024, Bryan Police responded to the defendant’s home after receiving a disconnected 911 call. Upon arrival, they discovered the victim severely beaten and requiring immediate medical attention. Medical personnel and police documented severe bruising and swelling to the victim’s face, stomach, and chest. The victim reported that she was 11 weeks pregnant and had lost consciousness during the assault.

Police spoke with the victim, who stated that she and the defendant got into an argument. The defendant then locked her in the RV and stated “Welcome to Hell House,” threatening to make sure she didn’t have the baby. According to the victim’s statement, the defendant grabbed her by the hair and repeatedly punched her in the face and stomach. The defendant then grabbed a 10-inch kitchen knife and threatened to kill her, holding the knife up to her neck. The victim begged him to stop, and he threw the knife on a table but continued punching, kicking, and kneeing the victim until she lost consciousness.

While the defendant was outside the RV disposing of evidence from the crime scene, the victim called 911, gave an address, and hung up. When the victim told the defendant that she and the baby needed medical help, the defendant instructed her to fabricate a story about two female individuals assaulting her so that he would not get in trouble.

Bryan Police responded quickly to the scene and were able to place the defendant in custody and figure out what actually happened. A kitchen knife was located at the scene. The knife resembled a chef’s knife with a black handle and a blade approximately 10” in length. During the investigation police officers discovered signs of disturbance inside of the trailer, namely broken glass and blood
on the floor, were observed by the Bryan Fire Department medics on scene.

This case was investigated by the Bryan Police Department. Medical staff from Scott and White Forensic assisted in the investigation and provided valuable treatment to the victims. Assistant District Attorneys Adam Andreski and Rachel Porter prosecuted the case with the aid Victim Assistance Coordinator Shae Cooks and Investigator Mike Johse.
