Bryan Man Pleads Guilty To 2019 Drunk Driving Head On Crash That Injured The Other Driver

A Bryan man admits to drunk driving that caused a head on crash in west Bryan just over two years ago.

According to the Brazos County district attorney’s office, the blood alcohol level of 20 year old Edgar Perez-Vita was nearly three times the legal limit at .232.

Prosecutors say the driver of the car continues to suffer from back pain from the collision on West Villa Maria near Highway 47.

Vita, who did not have a driver’s license or insurance, was convicted of DWI for the second time.

As part of an agreement, Vita pleaded guilty to intoxication assault and was sentenced to seven years in prison.

While he has to serve three and a half years before becoming eligible for parole, Vita has been in jail since his arrest in May of 2019.

He has also been held for immigration authorities.

Edgar Perez-Vita pled guilty to Intoxication Assault on June 1, 2021 and was sentenced to seven years in prison.

On May 5, 2019, officers from the Bryan Police Department were dispatched to a major head-on collision in the 3300 block of West Villa Maria Road at 8:00 at night.

The victim was headed westbound towards Highway 47 on Villa Maria Road. The defendant, headed eastbound, away from Highway 47, crossed into the victim’s lane of travel.

The victim tried to make an evasive action and was struck at a high rate of speed on his passenger side.

As a result of the crash, the victim’s vehicle was totaled and he was rushed to the hospital with multiple injuries. EMS responded to the crash to treat both drivers.

The defendant had an unopened beer can in his pocket that was found by a paramedic treating him, as well as multiple open containers in his vehicle.

He had a strong odor of alcohol and failed a Field Sobriety test. His blood sample showed an alcohol concentration of .232, nearly 3 times the legal limit.

The victim was hospitalized with a concussion and was comatose through the night. After waking the next morning, he was stable and released to his home. He continues to suffer from back pain to this day.

The defendant pled guilty to a 3rd Degree felony charge of Intoxication Assault, with a range of punishment of 2-10 years. He was sentenced to 7 years in prison.

The sentence also included an affirmative finding of a Deadly Weapon. With that finding, he must serve at least half of his sentence before being eligible for parole.

The defendant did not have a driver’s license or insurance for his vehicle. He has 1 previous conviction for DWI in 2013, where he was sentenced to 110 days in the Brazos County Jail.
