A Brazos County district court jury has decided it was murder and not self-defense from a shooting in the parking lot of a Bryan apartment complex just over two years ago.
The jury took four and a half hours Thursday to convict 41 year old Sosimo Gonzales in the death of Andres Tula-Penaloza.
On Friday, the jury heard arguments in the punishment phase then deliberated three and a half hours before returning with a 40 year sentence. Prosecutors had sought at least 50 years and also asked to consider a life term. The defense requested the lower end of the range, of which the minimum was five years. Gonzales was also fined $10,000.
According to the arrest report, the two men had exchanged words at a College Station nightclub before the shooting in the parking lot of Image Apartments off Finfeather Road on September 1, 2013.
