Accused Judge Wants Separate Trials

HOUSTON (AP) _ A federal judge accused of fondling two female court employees and trying to force them into sexual acts is asking for separate trials.

U.S. District Judge Samuel Kent is facing five counts of sexual abuse and one count of obstructing justice. He wants the obstruction charge either dropped or tried separately.

The Houston Chronicle reports that Kent made the case for the separate trials this week in court filings. He said two trials are necessary because he must take the stand in the sexual abuse cases and he must not testify on his own behalf in the other case.

Dick DeGuerin, Kent’s lawyer, told U.S. Senior Judge Roger Vinson, of Florida, that Kent had everything to lose and nothing to gain by testifying in his own defense in the obstruction charge.

He asked that the charge be dismissed as vague and because it fails to meet the elements of the statute.

Kent is to stand trial Feb. 23.
