A Bryan man is going to prison for the fifth time.

That’s after a plea agreement was reached this week (May 28) in Brazos County district court between 47 year old Joe Hernandez Jr. and the district attorney’s office.

Hernandez was sentenced to a total of 25 years for seven felony crimes.

Four of the felonies were in December 2022, associated to firing a gun during a disturbance where a Bryan police report says officers found five spent rounds. He was convicted of aggravated assault with a deadly weapon, deadly conduct by discharging a gun, unlawful carrying of a weapon by a felon, and unlawful possession of a weapon by a felon.

Three of the felonies were in June 2022, where he was convicted of possession of a controlled substance, evidence tampering, and evading arrest.

The plea agreements say Hernandez can not appeal the convictions or punishment.

Online court records show Hernandez was previously sentenced to prison in 1996, 2005, 2010, and 2018.
