Bryan City Council Approves Settlement In Lawsuit Filed By A Adult Themed Business


Representatives of the city of Bryan and the parent company of Austin based adult novelty store Planet K have signed off on a settlement that resolves a lawsuit against the city.

An adult themed business in Bryan may be moving its operation indoors, after spending the last six months working from a tent in their parking lot.

The Bryan city council Tuesday night unanimously approved a settlement agreement with the parent company of Planet K.

City manager Kean Register told WTAW News details would be released once the deal is signed.

Planet K filed a lawsuit against the city and the city’s board of zoning adjustments last November in an attempt to do business inside its building on Texas south of Villa Maria.

According to online court records, negotiations to settle the lawsuit have been going on for at least three months.

Planet K accused the city of having a sign code that violates free speech rights under the first amendment.

And Planet K says not having a sign permit has kept them from getting a permit to do business inside its building.

Text of the motion approved by the Bryan city council:

Councilmember Hairston moved to approve the Settlement and Release Agreement, as presented at this meeting, for Cause No. 18-002883-CV-272, styled AusPro Enterprises, L.P. vs. The City of Bryan and the City of Bryan Zoning Board of Adjustment, pending in the District Court of Brazos County, Texas, and to authorize the Mayor and/or the City Manager, as appropriate, to sign the necessary documents as set out in the Agreement and the exhibits attached to the agreement. The motion was seconded by Councilmember Simank and carried with all present voting aye.
