Lawyers For Both Sides In A Brazos County Civil Lawsuit Claim Victory

Both sides in a Brazos County district court lawsuit over last year’s district clerk election are claiming victory following a judge’s ruling.

The loser of last November’s election, Margaret Meece, sued the winner, Gabriel Garcia, over violations of the Texas Election Code.

The lawyers representing Meece and Garcia issued news releases after a judge from Montgomery County assigned to the case granted part of Garcia’s motion to dismiss the lawsuit.

According to Garcia’s lawyer, the judge dismissed a majority of Meece’s claims.

Meece’s lawyer says what the judge dismissed does not apply to Meece’s claims that Garcia committed felony and misdemeanor violations during his run for district clerk.

Garcia’s lawyer also announced he will appeal the judge’s decision not to dismiss the remaining claims. Meece’s lawyer claims the appeal is being pursued “for frivolous and dilatory purposes.”

Both lawyers also made references to pursuing legal sanctions and attorney fees against the other.

A trial, with or without a jury, is scheduled to start October 28th.
