AUSTIN, Texas (AP) _ An agreement has been reached that will allow Travis County District Attorney Rosemary Lehmberg to avoid a jury trial resulting from her arrest in April for drunken driving.
But the Austin American-Statesman reports (http://bit.ly/18tzHHi ) Judge David Peeples now will decide whether she should be removed from office. A decision is expected in December.
The jury trial was scheduled to start Monday but Peeples and both parties in the matter agreed at a hearing Friday to waive it.
Peeples had earlier ruled that jurors would be responsible for deciding whether Lehmberg was intoxicated, and if so, then determine whether to remove her from office.
Because Lehmberg has already pleaded guilty to driving while intoxicated, her attorneys said Friday that the civil trial was unnecessary.
If Peeples does decide to remove Lehmberg, she could still appeal the decision.
