Plea & Sentencing Agreement After The Jury Is PickedFeatured Stories, News Wednesday, July 24th, 2013
A Brazos County District Court jury was at the courthouse for a day and a half this week for a criminal trial that ended in two plea agreements.
Before the jury started hearing prosecution testimony on a charge of stealing a skid steer loader last summer, 36 year old Martin Garcia of Bryan entered a guilty plea.
The trial then moved to the punishment phase. When prosecution witnesses started talking about three other thefts last summer and Garcia’s criminal history, which dates back to 1995 and includes eight prior convictions for property crimes, the defendant asked for a deal on sentencing.
That led to an agreement on a nine year prison term on all four thefts. Garcia agreed to not appeal his conviction or the sentence.
A news release from the district attorney’s office credited the cooperative effort of the sheriff’s office and both police departments for catching Garcia and returning the stolen property, which also included a motorcycle, a trailer with welding equipment, and a riding mower.
