A Bryan man arrested four and a half years ago for downloading child pornography on his family’s computer is off to prison.

A jury trial in Brazos County District Court ended in a plea agreement where 37 year old Nivlac Simmons was sentenced to ten years, he won’t appeal the conviction and punishment, and he’ll be required to register as a sex offender the rest of his life.

Assistant Brazos County District Attorney Jessica Escue says it took time to determine it was the defendant who downloaded close to 300 images between 2005 and and his arrest in 2008.

Escue says the computer was shared with Simmons’ wife and their four children. She says FBI agents in Illinois detected Simmons downloading images of child victims from the national center for missing and exploited children.
