Judge’s Ruling Allow CS Recall Election May 14th

Brazos County District Judge Travis Bryan ruled Thursday the jurisdiction of a recall election against College Station’s Mayor and two councilmembers rested with the city.

That decision upholds the city council’s decision to schedule the recall election May 14th.

Recall supporters and Wellborn annexation opponents sued the council in January, wanting the election on March 28th and asking the judge to take control.

Bob Heath of Austin was the lawyer hired by the City of College Station.

Rusty Adams of Bryan was the lawyer hired by those seeking to move up the election date.

Tim Delasandro was one of the plaintiffs in the lawsuit and sat with Adams at Thursday’s hearing.

Among those in the audience following the hearing was Jane Cohen of Citizens For Wellborn.

Most of Thursday’s court hearing was lawyer’s arguments. The only witness, City Secretary Sherry Mashburn testified preparations have been made for the May 14th election date and nothing for March 28th had the judge ruled in favor of the plaintiffs.
